Welcome to Nostalgicard. These Terms of Service ("Terms") govern your use of the Nostalgicard website at nostalgicard.com(the "Service"), operated by Nostalgicard ("we," "us," or "our"). Please read these Terms carefully before using the Service.

1. Acceptance of Terms

By accessing or using Nostalgicard, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use the Service.

2. Eligibility

You must be at least 13 years of age to use Nostalgicard. If you are between the ages of 13 and 18 (or the age of majority in your jurisdiction), you may only use the Service with the consent of a parent or legal guardian. By using the Service, you represent that you meet these eligibility requirements.

3. Your Account

• You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
• You must provide accurate and complete information when creating your account. Usernames must be at least 3 characters and may only contain letters, numbers, and underscores.
• You may not create multiple accounts for the purpose of evading bans or manipulating the platform.
• You must notify us immediately of any unauthorized use of your account.

4. User Content

4.1 Ownership

You retain ownership of all content you upload to Nostalgicard, including photos, videos, posts, comments, and messages ("User Content"). We do not claim ownership over your content.

4.2 License Grant

By posting User Content on Nostalgicard, you grant us a worldwide, non-exclusive, royalty-free, sublicensable license to use, display, reproduce, and distribute your content solely for the purpose of operating and improving the Service. This license ends when you delete your content or account, except where your content has been shared by other users or is reasonably necessary for the operation of the Service.

4.3 Content Processing

Uploaded images may be automatically resized and converted to WebP format for performance optimization. Videos are limited to 50MB. We accept JPEG, PNG, WebP, and common video formats.

5. Prohibited Conduct

You agree not to engage in any of the following:

• Counterfeit cards: Posting fake, counterfeit, or proxy cards as genuine without clearly labeling them as such.
• Harassment: Bullying, threatening, or harassing other users through posts, comments, messages, or any other means.
• Spam: Posting repetitive, unsolicited promotional content, or using automated tools to interact with the Service.
• Fraud and scams: Attempting to defraud other users through fake trades, sales, or misleading pricing claims.
• Illegal content: Posting content that violates any applicable law or regulation.
• Impersonation: Pretending to be another person, brand, or organization.
• System abuse: Attempting to exploit, hack, or disrupt the Service, its infrastructure, or its APIs.
• NSFW content: Posting sexually explicit, excessively violent, or otherwise inappropriate content.

6. Card Pricing Disclaimer

Nostalgicard provides card market price information through features such as Market Watch and individual card price lookups. This pricing data is sourced from third-party services including eBay sold listings and active listings and is provided for informational purposes only.

• Price data may be delayed, incomplete, or inaccurate.
• Nostalgicard does not guarantee the accuracy, timeliness, or completeness of any pricing information.
• Price information does not constitute financial advice, investment advice, or an appraisal.
• You should conduct your own research before making any buying or selling decisions.

7. Intellectual Property

The Nostalgicard name, logo, design, and original content are the property of Nostalgicard and are protected by applicable intellectual property laws.

Yu-Gi-Oh! is a registered trademark of Konami Holdings Corporation. Nostalgicard is not affiliated with, endorsed by, or sponsored by Konami Holdings Corporation or any of its subsidiaries. All Yu-Gi-Oh! card names, images, and related content are the property of their respective owners.

Card images and data displayed on the Service may be sourced from the YGOProDeck API and are used under their terms of service.

8. Third-Party Services

Nostalgicard integrates with and relies on third-party services including Supabase, Vercel, eBay, and YGOProDeck. We are not responsible for the availability, accuracy, or content of these third-party services. Your use of such services may be subject to their own terms and conditions. Links to third-party websites (such as eBay listings) are provided for convenience and do not imply endorsement.

9. Termination

• You may stop using Nostalgicard and request account deletion at any time by contacting us.
• We reserve the right to suspend or terminate your account at our sole discretion, without prior notice, for any violation of these Terms or conduct that we determine to be harmful to the Service, other users, or third parties.
• Reported users may have their content reviewed and accounts suspended pending investigation.
• Upon termination, your right to use the Service ceases immediately. Sections of these Terms that by their nature should survive termination will remain in effect.

10. Disclaimers

The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

• We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.
• We do not warrant the accuracy or reliability of any content posted by users or provided through third-party integrations.
• We are not responsible for any transactions, trades, or agreements made between users outside the platform.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Nostalgicard and its operators, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from or related to your use of the Service, regardless of the theory of liability. Our total liability for any claim arising from the Service shall not exceed the amount you paid us (if any) in the 12 months preceding the claim.

These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms or the Service shall be resolved through good-faith negotiation first. If negotiation fails, disputes shall be submitted to binding arbitration or resolved in a court of competent jurisdiction.

We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Last updated" date at the top of this page and may notify users through the Service. Your continued use of Nostalgicard after changes are posted constitutes acceptance of the revised Terms.
